The litigation finance market is relatively new. It is experiencing growth in both demand and supply. There are only a few publicly listed litigation finance companies. The bulk of investing capital originates from a few private litigation finance managers.
Financial assets are becoming highly correlated thereby increasing the need for greater diversification. Legal claims as an asset class are often considered to be non-cyclical and uncorrelated with underlying economic conditions.
Litigation finance has the potential to level the playing field between underfunded plaintiffs and “Goliath” defendants. Thus, it also has the potential to improve organizational behavior.
